In the recent hearing of marital dispute of couple, the husband sought divorce from his wife but wife denied divorce and filed a case for alimony and demands equal settlement amount received by husband’s first wife which was 500 crores.
Justice Nagarathna said, “A Hindu marriage is a sacrament and is considered to be a sacred institution as a foundation for a family, and not a commercial venture.” The Supreme Court-dissolved this case and directed the husband to pay 12 crore rupees to the wife as a permanent settlement. It also gave 8 guidelines for alimony determination.
8 Points for Alimony Determination
- Social and Economic status will checked of both parties.
- Long term needs of wife and children will be considered.
- The source of income and assets of each parties will be checked.
- Standard of Living (Lifestyle of wife will be considered when she was with husband)
- Sacrifice made by wife in terms of job or career opportunities.
- Legal costs of non earning wife will be added in the alimony.
- Husbands liabilities, dependents, and income will be considered.
